As e-cigarettes become more and more popular, organizations like the Food and Drug Administration (FDA) are beginning to take notice of some of the potentially dangerous products taking over the market. Recently, a China-based company called HelloCig Electronic Technology Co., Ltd. was discovered making an e-cigarette liquid that contained hazardous ingredients often found in Viagra and Cialis. The company advertised their E-cigarette products as treatments for erectile dysfunction, though the FDA never approved the use of these substances in vaping products. The FDA has expressed their concern over the hazards of these products and this October issued a warning letter to the company for their wrongdoing, ordering them to respond within 15 days and discontinue the sale of their e-liquids. However, it is possible consumers could have been misled or harmed by these products. Dangerous Drugs in E-Liquid Solutions According to the FDA, the ingredients HelloCig included in their e-liquids were approved drugs for certain erectile dysfunction medications—but those drugs were not approved for inhalation. Because the side effects of these drugs have not been studied in this form, the FDA does not support their sale for e-cigarettes. HelloCig even went so far as to use Viagra and Cialis marketing on their ads, claiming that their e-liquid could treat erectile dysfunction. Moreover, the company also used Acomplia, a weight loss drug that is not approved by the FDA, labels in their advertising. Again, the FDA reiterated that they did not approve such advertising. On their website, the FDA says that HelloCig’s advertising language “conveys, misleads, or would mislead consumers into believing that the tobacco products are approved by FDA.” In the warning letter, the FDA accuses the e-cigarette company with misbranding the tobacco products, misbranding the drugs they used and violating the protocol for unapproved new drugs. Potential Health Risks HelloCig’s actions could result in serious injuries to any consumers who have used their e-liquid solutions that contain Acomplia, Viagra, or Cialis. The products containing these ingredients were sold through misleading advertising, mislabeling, and other deceptive and confusing marketing tactics. As a result, consumers may have ingested unsafe products that were not approved by the FDA for the use of vaping. Although the health risks are unknown, the FDA has strongly expressed its concern regarding the severity of these health violations. Legal Action After the FDA issued the warning letter to HelloCig, the e-cigarette company was given 15 days to issue a response, after which point the FDA can take legal action. If you or someone you love was harmed by the HelloCig products, or another product that was sold through misleading advertising, you may have a right to pursue legal action. Damages for personal injury cases involving dangerous drugs and products may include reparation for pain and suffering, loss of wages, and medical expenses.
